Happy Valley, OR – Four members of a Happy Valley family who claim an improperly installed swimming pool heater gave them carbon monoxide poisoning are suing the construction company that did the job.

The lawsuit filed earlier this month in Clackamas County claims that a Wilsonville company, Victory Construction, built an indoor pool with a natural gas heater in the basement of the family’s home.

Victory Construction replaced the heater’s igniter in August 2013 but the heater wasn’t properly vented, the lawsuit alleges.

Four days after the work was done, the heater “released carbon monoxide inside the home at levels that were high enough to cause carbon monoxide poisoning” to Pravin Kumar and three family members, according to the lawsuit.

Victory Construction owner Vitaliy Shavlovskiy did not return a call Wednesday made to the company’s office.

The Kumars are seeking a total of $52,253 in medical expenses and $85,000 in non-economic damages.
